Terms and Conditions

By accessing or using BabyHavyn (the "App"), operated by TMK Labs LLC, or by buying a gift through it, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the App.

Description of Service

The App is a private tool that helps families coordinate visits, meal drop-offs, and help requests around a newborn. A household is joined by invitation from one of its parents, or by redeeming a gift that someone has bought for you.

Access to a household runs for a period of time — a free trial to begin with, and after that a paid or gifted period. See Access, Trials, and Paid Periods below.

Eligibility

You must be at least 18 years old to create a household, verify a phone number, or buy a gift through the App. A gift should only be bought for someone who is also at least 18.

Your Account

• You're responsible for keeping your phone number and any device you use to access the App secure.
• You're responsible for the accuracy of the information you provide.
• A household's parents are responsible for who they invite and what access they grant.
• A household's parents are responsible for any address, gate code, or entry instructions they choose to add, and for understanding that this information is visible to everyone currently on that household's visitor list.

Access, Trials, and Paid Periods

Every new household starts on a free trial, currently 15 days, running from the moment the household is created. No payment details are required to start one, and it does not renew or convert into a paid period by itself — nothing is charged unless you choose to buy access.

The trial length is fixed when your household is created. If we change it for new households later, yours is unaffected. The current length is shown in the App before you start.

Paid access runs for a fixed period, not indefinitely. When you buy access — or when a gift is activated — the length of that period is shown to you at the time, and the end date is fixed then. If we later change the standard length, your period is unaffected; the change only applies to periods that begin after it.

Buying access is not a permanent or one-off purchase of the App. It buys a defined period of use, and a further period must be bought to continue after it ends.

What happens when a period ends. If a trial or paid period ends and nothing is queued to follow it, the household becomes read-only:

• Nothing is deleted. Everyone in the household can still sign in and see what was already arranged.
• Nothing new can be booked, requested, or invited.
• Visitors can still cancel a visit, meal, or drop-in they had already committed to, so that no one is left holding a commitment they cannot withdraw.
• A parent can restore full use at any time by buying a further period. Everything returns as it was — the same household, not a new one.

We do not guarantee that a household will be usable after a period ends without a further purchase, and read-only access is not itself a guaranteed or permanent service.

Gifts

Access to the App can be bought as a gift for someone else. You do not need an account to buy one. We ask for your name, email address, and phone number so we can send you the gift link and reach you about the purchase, and for the recipient's name so the gift can be addressed to them. We do not ask you for the recipient's phone number or email address, and you should not send them to us.

• The gift link is sent to you, the purchaser. Passing it on to the recipient, and choosing how and when to do that, is up to you. We do not contact the recipient.
• A gift is redeemed by the recipient verifying a phone number. Whoever redeems it becomes the person the gift applies to, so gift links should be treated as valuable and shared only with the intended recipient. The recipient's name is there to address the gift and does not by itself restrict who can redeem it — the link is what carries the value.
• A gift does not expire unless an expiry is stated at the time it is bought. A gift bought months before a baby arrives will still be there.
• A gift does not start counting down until the recipient activates it. A recipient can set their household up at their own pace beforehand; the period of access begins only when they choose to start it.
• If the recipient's household is already active, the gift is held rather than applied. It does not shorten, overlap, or replace the access they already have — it takes effect when their current period ends. If more than one gift is held, they are used one after another, in the order they were redeemed.
• A gift has no cash value to the recipient and cannot be exchanged by them for money or credit, and it is not transferable once redeemed. The purchaser may request a refund while it remains unredeemed — see Payment and Refunds.
• You are responsible for the details you give us, including the recipient's name. Please only buy a gift for someone you know personally.
• Buying a gift does not give the purchaser any access to, or information about, the recipient's household.

Payment and Refunds

Prices are shown before you pay. Payment is taken by our payment processor; we do not receive or store your card details.

Once a period of access has been activated, it is not refundable. This applies however that period was paid for — bought directly for your own household, or received as a gift and then activated. Buying access for your own household activates it immediately, so those purchases are not refundable.

An unredeemed gift can be refunded within the refund period shown at the time it was purchased — currently 30 days from the purchase date. To request one, contact us at info@tmklabs.com from the email address used to buy it. Refunds are returned to the purchaser and to the original payment method.

The refund period is fixed when a gift is bought. If we change it for future purchases, gifts already bought keep the period they were sold under.

A gift stops being refundable once it has been redeemed, even if the recipient has not yet activated it — redeeming attaches the gift to a specific person and household. If a gift has gone to the wrong person or is no longer wanted, contact us before it is redeemed.

Nothing in this section limits any refund or cancellation right you have under applicable law.

Where we have made a specific written commitment to a household — for example, that a beta tester's household remains free — that commitment stands regardless of the general terms in this section.

Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to access a household you haven't been invited to
• Share invite links with anyone the household's parents haven't approved
• Share a household's address, gate code, or entry instructions with anyone outside that household
• Interfere with or disrupt the App's operation
• Use the App to send unsolicited messages or spam

Your Content

You retain ownership of the information you submit (visit notes, help request descriptions, meal details, address and access details, and similar content). By submitting it, you grant us permission to store and display it to other members of your household for the purpose of providing the App's coordination features.

SMS Consent

By providing your phone number, you consent to receive one-time verification codes via SMS as described in our Privacy Policy. Message and data rates may apply. Reply STOP to opt out, HELP for assistance.

Disclaimers

The App is provided "as is" and "as available," without warranties of any kind. We do not guarantee the App will be uninterrupted or error-free, or that any particular visit, meal, or help request will be fulfilled — the App is a coordination tool, and outcomes depend on the actions of your household's members.

Address, gate code, and entry instructions are entered by a parent and shown to that household's members as provided. We do not verify them, and we are not responsible for information that is inaccurate, out of date, or left in the App after it should have been removed.

Limitation of Liability

To the fullest extent permitted by law, TMK Labs LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the App, including missed visits, scheduling conflicts, reliance on information shared by other household members, or the sharing of a household's address or access details by someone that household invited.

Termination

We may suspend or terminate access to the App for anyone who violates these Terms. You may stop using the App at any time; contact us to request deletion of your account and data.

Access also ends, without any action by us, when a trial or paid period runs out and nothing follows it. That is not termination — the household becomes read-only as described in Access, Trials, and Paid Periods, and can be restored at any time.

A parent can permanently delete their household from within the App. This is irreversible and removes the household's content for every member, not only for the parent who deletes it.

Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes take effect means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of California, without regard to conflict of law principles.
